CCR Amendments Discussion

Currently, section 1.7 of our CCRs require an 80% vote in the affirmative to amend the them.

The recent vote to amend Section 1.7 of the CCRs did not pass. The board received only 30 votes, which is 60% of our members. Even if they were all votes to approve the measure, it still would not have passed.

This illustrated to the board that, as currently written, amending the CCRs will require a great effort. We also received some helpful feedback that, perhaps, more people would be willing to lower the amendment threshold if it were structured differetly to still be difficult to amend, but not so difficult. This is understandable.

In our meeting we will discuss a few ways to structure this. While there will NOT be time to dig into the various things the Board seeks to amend, here is a small sampling of types of things that could be discussed and potentially amended – this is for illustrative purposes only.

  • Section 2.7 – Fines Enforecement: there is no existing fine schedule for enforcement leaving it up to the Board’s discretion
  • Section 3.5 – Driveways and Mailboxes: remove language that requires brick mailboxes, as many current mailboxes are not brick
  • Section 3.8 – Fences: allow more flexibility in fences in backyards that are not seen from the street
  • Section 3.16 – Views from Street or Lot: the rules regarding trash cans are likely contentious and need to be discussed
  • There are currently no provisions/restrictions/guidelines for things such as:
    • solar panels
    • long-term renting of homes (1-2 year leases)
    • short-term renting of homes (Airbnb/Vbro/etc)

In the end, what it boils down to is: the HOA needs to start enforcing the CCRs as they are written if we cannot change them.

Board Member Election

Our Bylaws state that we need to have, at minimum, three board members.

In our last meeting, Tyler stepped in to fill a temporary hole in our board until this next meeting where we can hold an official board election. He will not be seeking re-election, but has promised to continue helping the HOA out in various capacities (gate access + website).

We need to elect a new board member who will serve a two-year term beginning in January 2026. The board expects to meet quarterly and have sporadic communications in between to take care of business and keep things moving forward for the community.
